Abstract

The Creative right is a kind of right that gives the owner the ability to creat an  effect on others that includes the modification, termination or creation of alegal status for others , and third parties to comply and submit to this effect. Islamic jurisprudence knowns middle status that corresponds to the Creative right in jurisprudence. The Creative right is a degree of right, but less of a scope and content than the ordinary right because it does not creat an obligation on others
