The Rule of Prevention of Combination Between the Possession and Right Claims (Contrastive and Analystic Study)

Abstract

              It is normal and it is to perform the legal security and the protection of appeared issues. The law gives the great importance to the possession. We have found it regulating the claims of possession.it has been decided the conditions of ensuring the legal protection to it but this protection may be faced with a hurdle that hinders to get its identified goal when decided the right in rem of another person for a thing possessed wether it is a right in a property or a right in rem so a non combination rule has come between the possession and right claim to complete the protection of possession its self free from the the base of the right therefore the defendant has been prevented from claiming the right or pushing him to the possession claim as well as the judge has also been prevented from having review and judgement on the bases of ensuring the right or not in the possession claims.
